General Terms and conditions of sale and payment

Art 1 : Scope

These general terms and conditions are in compliance with french law and CVIM Vienne 1980 as complement

Customer  is said to be informed of our general terms and conditions of sale and payment

All deliveries are carried out in compliance with our General terms of sale and payment.

Art 2 :  Orders

Order to become firm only after written confirmation by our company. All orders imply customer’s agreement upon general conditions of sale and payment terms.

Then after orders cannot be amended or cancelled unless agreement from our company. In case of cancellation of order , the deposit is due to our company.

Validity of order is permanently submitted to our financial department authorization.

Art 3 : Prices, Products

3-1 : Prices

Prices are only valid for current order, not for subsequent orders.

Our company  can revise the price lists without further notice.

3 -2 : Products

Our company can revise the range of products proposed to customers without further notice.

Orders could be thus cancelled. In case of customer having referenced same products, customer cannot claim for  indemnities .

Art 4 : Payment

Online payments are achieved through secure online bank  system

Art 5 : Passing of the risk

The goods are packed in a way to allow transportation safely

Art 6 : Delivery, Receipt,  Return

6 – 1 : Delivery

Our company is allowed to ship anticipated and/or partial deliveries.

Our company selects the mode of dispatch, unless otherwise agreed.

Shipment to be carried out only if customer has fulfilled his obligations towards our company, whatever the reason .

6-2 : Shipment date

Your parcel will be shipped within 48 hours when ready and in the current week when prepared on demand, such as necklaces cut at your length.

You will be noticed if there is a delay for any reason.

6 -3 : Receipt

Customer is obliged to inspect every delivery on acceptance or receipt to make sure it is complete and no damage to the packaging . Complaints  to be made immediately in writing in compliance with local transportation regulations. Copy to us.

Upon receipt of his order, customer must inspect  content and conformity of same with invoice in number and items shipped, any complaint to be made to us in writing within 3 days.

Our company is only responsible for replacement of missing or damaged merchandise.

Our company will not be liable for the loss of business or good or profits, or for costs or of any other incidental or consequential damage of any nature or description whatever which may arise from defect or non-conformity of products.

6 – 4 : Returns

Unfortunately, international orders are considered final sale once shipped and are ineligible for refund or exchange.

All sale orders are final.

Refund will be made within 2 weeks.

All bespoke sales : such as necklaces cut at your length on demand, are excluded from return policy, but are covered by the quality guarantee.

Art 7 : Retention of title

We retain title of all merchandises supplied by us until payment in full .

Art 8 : Guarantee

Our sole obligation and remedy for any any defects or damaged or non conformity of products shall be repair or replace, at our option.

Our company will not be liable for the loss of business or good or profits, or for costs or of any other incidental or consequential damage of any nature or description whatever which may arise from defect or non-conformity of products.

Any claim must be filed within 8 days of reception.

Guarantee only applies to customer who have fulfilled their obligations

Guarantee from our company  does not apply in case of unpredictable acts of God, inappropriate use of products, damages caused by repairs, mishandling, and inappropriate storage conditions

Art 9 : Responsibility

Products are not convenient for children under 6 years old.

Importation of goods are made under full responsibility of customer.

Customer will check and remain solely responsible for conformity of imported goods with local laws and regulations in country of importation.

Customs clearance in country of importation are fulfilled by customer  ; taxes and  handling  remain under  customer responsibility.

Our company is not responsible for consequences involved by any use of goods different from what they are dedicated to.

Art 10 :  Acts of God

Our company will not be held responsible for unpredictable acts of God.

Any new regulation of selling/ importing/exporting any good, and occuring after order is placed will imply cancellation of current order.

If goods had been previously paid, refund will be limited to the amount of goods ordered.

Our company will try as much as possible to warn customer about these  outcomes and consequences.

Our company will not be held responsible for any change of regulation between  dispatch  of order  and arrival in country of importation and which prevent  customer from taking delivery of goods and any consequences involved by such new regulations

Our company will not be liable for the loss of business or good or profits, or for costs or of any other incidental or consequences  raised by these new regulations.

Art  11 : Use of the brand registered mark, pictures and images

The use of NÄTTLA ® brand registered mark and all graphical representations such as logos, banners, and else, on any support and particularly the internet  support is forbidden unless specific written agreement from our company.

Sales are made under the brand mark NÄTTLA ®  must not be removed ; any forgery will be prosecuted.

Art  12 : Jurisdiction, applicable law and place of  fulfillment

The language of contract is French, English version of General Terms and conditions of sale and payment is only for information

Above mentioned terms are submitted to french law.

Place of jurisdiction is Paris Tribunal of Commerce
